xAI Takes Legal Action Against Grok User Over Child Deepfakes

Elon Musk’s AI firm, xAI, is suing a man for using its chatbot Grok to create illegal sexual deepfakes. The defendant, Terry Wayne Harwood, faces multiple felony charges for producing and distributing child sexual abuse material.

The lawsuit, filed on July 16, 2026, in Texas, accuses Harwood of exploiting two Grok accounts to generate disturbing, nonconsensual images. Harwood opened these accounts under false identities and manipulated Grok’s safeguards to bypass content restrictions.

Harwood’s documented activity began on December 8, 2025, and ended February 18, 2026. During that time, he uploaded images of minors, including a girl aged 10 to 11, and repeatedly pushed Grok to sexualize them despite the chatbot’s refusals. His prompts included requests to remove clothing and mimic “Playboy model” poses.

Authorities arrested Harwood in South Carolina on March 9, 2026. He now faces eight felony counts related to possession and distribution of child sexual abuse material. xAI’s attorneys say, “His conduct was knowing, intentional, and calculated.”

xAI has moved aggressively to police Grok. In 2026 alone, the platform suspended 52,222 accounts and filed 73,604 reports with the National Center for Missing & Exploited Children. Those reports have led to at least 244 arrests. Elon Musk stated bluntly, “Anyone using Grok to make illegal content will suffer the same consequences as if they upload illegal content.”

The lawsuit highlights the legal and reputational risks that come with AI platforms capable of image generation. xAI is seeking monetary damages and a court order barring Harwood from using Grok again. This case marks the first time an AI company has sued one of its users over content generated with its technology.

Despite Grok’s safety guardrails, Harwood’s actions show how determined users can tailor prompts to circumvent AI restrictions. xAI’s response signals a tougher stance on misuse—no more turning a blind eye to harmful content created with AI tools.
